GENERAL TERMS AND CONDITIONS OF SENSO4S ONLINE STORE

Senso4s online store (available at www.senso4s.com/en) is an online store (hereinafter referred to as “Senso4s Online Store”) is operated and managed by the company Senso4s d.o.o., headquartered in Blatnica 1, 1236 Trzin, Slovenia with registration number: 7184042000 and tax ID number: SI26941619 (hereinafter referred to as: “Provider”). The Senso4s Online Store is an IT system designed to present and sell products to end customers.

The Provider provides the operation of the Senso4s Online Store in accordance with the Consumer Protection Act (ZVPot), the Personal Data Protection Act (ZVOP), the Electronic Business and Electronic Signature Act (ZEPT) and the Out-of-Court Settlement of Consumer Disputes Act (ZisRPS).

The Provider sells goods in the Senso4s Online Store on its behalf and for its account.

The General Terms and Conditions determine the operation of the Senso4s Online store, rights and obligations of the Provider and customers. Customers must comply with the General Terms and Conditions applicable at the moment of purchase (placement of an online order). Upon placing an order, users are notified of the General Terms and Conditions and confirm that they are familiarised with the respective General Terms and Conditions.

The Provider reserves the right to change the General Terms and Conditions through the Senso4s Online Store without prior notice.

AN ONLINE STORE CUSTOMER

A user is a person who uses the Provider’s purchasing system, i.e., user is a customer of the Senso4s Online Store. A customer makes a purchase without any registration. A customer is considered a person with data stated upon placing the order. Subsequent changes in customer information are not possible.

A customer is required to provide the following information: surname and name, shipping address, telephone number and e-mail address, in order to receive a notification of order status. If the billing and shipping addresses are not the same, billing address is also required.

By placing an order, the customer confirms to agree with the Provider’s General Terms and Conditions published on this web page.

AN ONLINE STORE TERMS:

Customer may not use Provider’s products for any illegal or unauthorized purpose.

Please note that the Provider does not guarantee that all products presented on the Senso4s Online Store are in stock or are available for purchase. The Provider reserves its right to stop selling a product. Orders can only be placed by customers that are 18 years or older.

ACCESSIBILITY OF INFORMATION

Before placing and order, the Provider undertakes to provide to the customer the following information:

  • Provider information (name and registered office, registration number);
  • Contact information that provide quick and efficient communication between the Provider and the customer (e-mail, telephone number);
  • Essential characteristics of the products (with aftersales services and warranties), accessibility of products (each product offered online should be available within a reasonable period);
  • Delivery and services performance (delivery method, place and deadline);
  • Prices that should be clearly and unambiguously set as well as information on taxes and transport costs and other duties included;
  • Method of payment and delivery and validity of the offer;
  • Period in which it is possible to withdraw from the contract and terms and conditions for termination, including costs of returning the goods (description of the right of withdrawal in accordance with Article 43 of ZVPot; in cases when the customer has no right of withdrawal, the customer must be expressly informed thereof in accordance with Article 43 of ZVPot).
  • Explanation of the complaint procedure, including all information on a contact person or customer service.

GENERAL CONDITIONS

The Provider reserve the right to refuse service to the customer for any reason at any time.

Customer understands that their content (not including credit card information), may be transferred unencrypted and involve:

(a) transmissions over various networks; and

(b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms and Conditions.

MODIFICATIONS TO THE TERMS, CONDITIONS AND PRICES

Prices for the Provider’s products are subject to change without notice.

The Provider reserve the right at any time to modify or discontinue the Terms and Conditions (or any part or content thereof) without prior notice.

The Provider shall not be liable to a customer or any third-party for any modification, price change, suspension or discontinuance of the Terms and Conditions.

PRODUCT OFFER

The Provider may allow customers to purchase physical products.

The Provider shall seek to ensure that the information published on the Senso4s Online Store is up to date and accurate. Nevertheless, all information (price, delivery date, characteristics of the product) is not always updated in time. In this case, the Provider shall inform the customer about the changes and enable a cancellation of the order or change in the order.

Photos of the products sold are for illustrative purposes only and do not provide characteristics and quality of products.

DEFECTIVE PRODUCTS

If a customer receives defective products, they should notify the Provider immediately after they have detected that the products are defective. If the Provider reasonably determines that the products are truly defective, Provider reserves the right to send customer a non-defective identical replacement product.

PRICES IN ONLINE STORE

All prices provided in the Senso4s Online Store are in EUR (euro) and include VAT (Value Added Tax).

The regular price of a product is a price recommended by the Provider, discount in % indicates the amount of discount in the online store, price of a product is a regular price reduced by the discount for the particular product that is paid by the customers (it is the same for all customers).

Prices apply at the moment the order is placed and have no predetermined validity. If the information on the price is incorrect or if the price of a product changes during the order processing, the Provider enables the customer to cancel the purchase or proposes a solution agreeable to both parties.

PAYMENTS

Accepted methods of payment in Senso4s online store are Visa, Mastercard, American Express and China UnionPay. The Provider may change the prices for products at any time by posting new prices on Senso4s Online store.

By paying with their credit or debit card, a customer confirms that they are owner of this card used and that there are sufficient funds or credit available to cover the charges.

The purchase will appear on customer’s credit card or bank statement as SENSO4S D.O.O.

Billing to customer’s credit or debit card will take place at the time of customer’s purchase or soon afterwards.

The Provider uses Stripe Checkout to process payments. Stripe Checkout User Terms of Service are available at https://stripe.com/checkout/legal and its Global Privacy Policy at https://stripe.com/privacy.

RESALE POLICY

Customer should purchase products from Senso4s Online store for personal use only and not for resale. By placing an order on Senso4sOnline store, customer certifies that is purchasing products for their own personal use and not for resale.

DELIVERY PERIOD AND DELIVERY COSTS

Delivery period for ordered products on stock is seven to ten business days.

The Provider carries out delivery of ordered products through one of the delivery service to the shipping address provided by a customer. The delivery is free-of-charge.

HANDLING OF DAMAGED SHIPMENTS (COMPENSATIONS)

If the shipment is damaged in any way, lacks content or shows signs that has been opened prior to its arrival, the customer must initiate a complaint procedure. A customer needs to take clear photos of damaged goods, damaged parcel or packaging and the label of delivery service with legible number of the parcel and send the data to support@senso4s.com.

RIGHT OF WITHDRAWAL FROM PURCHASE AND RETURN OF GOODS

The customer has the right to withdraw from the purchase contract and return the goods purchased without any compensation. The customer must notify the Provider in written form about the intended return in no later than 14 days from the delivery of goods to the e-mail address support@senso4s.com and return the goods within the next 30 days.

The customer shall return the goods to the address Senso4s, d.o.o., Blatnica 1, 1236 Trzin, Slovenia. Upon return, the goods must be unused, undamaged, and the shipment has to contain a copy of the invoice and a completed return form.

The costs borne by the customer in regard with the withdrawal from the contract are the costs of the return of goods. The customer itself covers the respective costs that are charged according to the price list of a selected delivery service and depend on the size and/or weight of the product. Shipments including postal services that require the payment of goods upon delivery are not acceptable. We recommend selecting a delivery service that offers tracking of the shipment and returning the products in their original packaging or in other adequate packaging.

If the customer returns the goods in accordance with the procedure for returning goods, the Provider refunds the purchase price in no later than 14 days after the withdrawal from the contract or returned goods is received.

The Provider can replace the goods for any other goods of the same value or send a refund depending on the customer’s request. The Provider refunds the purchase price to the customer’s bank account associated with the debit/credit card used for the original purchase.

ABSENCE OF RIGHT OF WITHDRAWAL

The customer does not have the right of withdrawal in contracts where the subject thereof is the product which has been produced according to the customer’s instructions, adjusted to its personal needs, is not suitable for return due to its nature, is highly perishable or its shelf-life has already expired.

It is not possible to withdraw from the contract:

  • For goods or services, the price of which depends on the market fluctuations that are out control of the company and can occur during the period of the withdrawal from the contract;
  • For goods produced according to the customer’s instructions and adjusted to their personal needs.

ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. The Provider reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information on website is inaccurate at any time without prior notice (including after a customer submitted their order).

Copyright in the documents provided in this site (including, without limitation, the trademarks of Senso4s, graphics, text, photos, designs, logos, icons, images, data and software) are owned by or licensed to Senso4s and its affiliates.

Customer is authorized to use this material only for personal, non-commercial purposes. Customer may download, print and store copies of this material for their own personal, non-commercial use, provided this Copyright Permission Notice is included in all such copies.

Customer may not charge anyone for use of the material and may not publish, duplicate or otherwise distribute the material to others without prior consent from Provider. Customer may not modify the material in any way, without the prior written permission of the copyright owner. Except as expressly stated in this legal notice, no rights or licenses to the material, or any portion thereof, shall be granted or implied.

COMPLAINTS AND DISPUTES

The Provider complies with the applicable legislation and strives to resolve all disputes amicably. The customer can submit complaints to the Provider’s e-mail address support@senso4s.com or to the company address: Senso4s d.o.o., Blatnica 1, 1236 Trzin, Slovenia by including the wording “Complaint”. The Provider will try to address the received complaints as soon as possible and find a favourable solution together with the customer. If the solution cannot be found, the competent court of the place of the registered office of the Provider shall have jurisdiction to resolve disputes.

The Provider informs the visitors of the web page as well as prospect and existing customers which have the status of the consumer within the meaning of the first paragraph of Article 4 of the Out-of-Court Settlement of Consumer Disputes Act (ZIsRPS), in accordance with the third paragraph of Article 32 of the Out-of-Court Settlement of Consumer Disputes Act that it does not recognise any provider of the out-of-the-court settlement of disputes as competent for resolving a consumer dispute which may be initiated by the consumer in accordance with the respective Act, meaning that any potential disputes not resolved in agreement between the parties are resolved in front of the competent court of the Provider.

The above-stated arrangement stems from the Out-of-Court Resolution of Consumer Disputes Act, Regulation (EU) No. 524/2013 of the European Parliament and of the Council on online dispute resolution and amending Regulation (EC) No. 2016/2004 and Directive 2009/22/EC.

CHANGES TO TERMS AND CONDITIONS

The Provider reserve the right at our sole discretion, to update, change or replace any part of these Terms and Conditions by posting updates and changes to its website. It is customer’s responsibility to check our website periodically for changes. Customer’s continued use of or access to Provider’s website following the posting of any changes to these Terms and Conditions constitutes acceptance of those changes.
